Builder cheated not only buyers....they cheated authority also

If the authorities are really serious about protecting home buyers interest, a forensic audit w.r.t to original plan and revised plan needs to be conducted in order to call builders bluff.In any case ,Builder should have obtained consent of flat buyer before going ahead with revised enhanced super area.

I too have taken possession of flat in TOWER M. I really feel cheated that builder has enhanced super area from 1175 sq.feet to 1234 sq feet.

The Noida authority on Monday directed realty firms — Gardenia India Private Limited and Logix Infratech Private Limited — to address issues faced by homebuyers who invested in their housing projects.
The authority’s additional chief executive officer AK Shrivastava, officer on special duty Santosh Kumar and other officials of the planning department addressed buyers’ issues at a tripartite meeting at Indira Gandhi Kala Kendra in Sector 6.
Gardenia India Private Limited has a housing project named Gardenia Gateway project, located in Sector 75. And, Logix Infratech Private Limited has a housing project under the name Logix Blossom Greens, situated in Sector 143.
“I had booked a flat in 2010 and even after seven years of delay, the builder cannot tell me when he will deliver the flat. The builder is yet to finish work on pool, club lifts and other facilities. Around 100 buyers have shifted to partially completed towers. The builder has charged more money in the name of 10% super area increase in each flat. In reality, however, there has been no such increase,” Dinesh Sharma, a flat buyer, said.
The builder said that he had developed 600 flats on plot number 9, but couldn’t build any on plot number 10 because of a litigation pending in Allahabad High Court.
“We have directed the builder to submit replies to all complaints made by the buyers at the meeting. The builder also will have to get back to us on the buyers’ demand for penalty in the event of delayed possession,” the ACEO said.
In a stern message to the builder, the authority said that if they fail to address homebuyers’ issues as per the scheduled plan that is to be submitted, strict action will be taken to ensure justice for homebuyers.
Buyers who booked or bought flats in the Logix Blossom Greens project said the builder was offering possession of flats without making provision for basic facilities.

“I have directed the planning team to conduct an inspection at the Logix Blossom Greens to find out whether basic facilities are developed by the builder or not. Our planning team will conduct an inspection on June 15 and submit a report on the same. Apart from this, the Logix builder will have to submit a detailed plan to address buyers’ issues by June 16. We will also examine how the occupancy certificate was issued to the building if basic facilities are yet ti be provided for,” said Santosh Kumar, officer on special duty, Noida authority.
